The power of attorney establishes the scope of representation and is the basis for the representative organization to perform the work on behalf of the customer.

When the customer uses an industrial property representative organization, the power of attorney is a document showing the designation and limitation of the tasks that the representative is allowed to perform.

Common contents

A power of attorney should clearly identify the principal, principal, subject or group of procedures, the scope of action, and the effect. Depending on the need, the scope may include filing, amendment, extension, assignment, license, objection, complaint or valid handling of the degree.

The scope should be consistent with the service

Power of Attorney and service contracts have different roles. The power of attorney establishes the right of representation before the agency, while the contract describes the beginning of work, fees, payment, coordination and responsibilities between the customer and the service provider. The two documents need to agree on the scope.

Pre-sign check

  • The name and address of the principal must be consistent with the dossier.
  • The signatory must have appropriate authority.
  • The scope of authorization should be sufficient for the intended procedure but should not be ambiguous.
  • The date of signing, method of signing and requirements for originals should be confirmed on a case-by-case basis.

Archive and update

The customer should keep the signed copy with the application and contract documents. When changing the representative, scope of work or applicant information, it is necessary to check whether a new power of attorney must be established or the procedure for recording the change is carried out.
